Manslaughter Charges Filed Over Accident

Howard Ellison, 32, of Greenland, was charged in Washington County Circuit Court Friday morning with three counts of involuntary manslaughter.

Ellison was the driver of the vehicle that collided head-on with that of a Rogers family Jan. 21, killing three persons.

Robert Leroy Pendley, 29, his wife, Betty A. Pendley, 30, and their 5-month-old son, Robert E. Pendley, all of Rogers, were pronounced dead at Washington General Hospital in Fayetteville after the crash.

Ellison, who is still in the hospital, is listed in fair to good condition. A passenger in his car, Edith Jones, 47, of Springdale, is in fair condition. One other occupant of the Pendley vehicle, Betsy Lee Pendley, 7, survived the crash and was discharged from the hospital Thursday.

The manslaughter charges were filed as a result of blood alcohol tests and interviews with witnesses of the accident, according to Washington County Prosecutor Mahlon Gibson.

Police said that Ellison's car apparently crossed the center line into the northbound traffic lane on the bypass around Fayetteville. Pendley attempted to veer left to avoid the crash, police said, when Ellison apparently began to return his vehicle to its proper lane and the two cars collided.
