The two marshals were looking for John Bart, a Cherokee Indian, wanted for whiskey violations. They found him in a cornfield east of Webbers Fall with a man named Johnson Jacks. Bart had been warned and as the officers approached Bart and Jacks opened fire killing Beck instantly. Merritt returned the fire but was struck in the chest. Merritt managed to shoot Jacks twice in the stomach before receiving another shot in the head. Jacks managed to approach Merritt as he lay on the ground almost dead and shot him several times before beating him in the head with his pistol. Bart then helped the wounded Jacks to a nearby cabin before making his escape. The US Deputy Marshals were then out in full force and later arrested Jacks, who confessed to killing both officers.
